Definitions

In these terms & conditions, the following definitions apply:

• Blauw Natuurlijk: the business/salon CALVD BV, trading under the name Blauw Natuurlijk;
• Client: the natural person who uses the services of the salon;
• Employee: the employee or independent contractor (self-employed) who performs services on behalf of Blauw Natuurlijk;
• Services: treatments in the field of lash styling, brow styling, nail care and other beauty treatments offered by Blauw Natuurlijk. Prices are available on the website and in the salon.

Article 1 - Applicability

1. These terms & conditions apply to all communications, services, treatments, products and materials of Blauw Natuurlijk. If a specific agreement exists, such as a treatment agreement, it is deemed to form part of this agreement.
2. The Client waives the applicability of their own general terms and conditions insofar as applicable. The applicability of any purchasing or other terms of the Client is explicitly rejected.

Article 2 - Appointments

1. Appointments can be made via the website, by email or in the salon. Once the appointment has been confirmed by Blauw Natuurlijk, it is binding.
2. Cancellations must be communicated at least 24 hours in advance. If cancelled less than 24 hours before the appointment, 100% of the treatment price will be charged.
3. In case of a no-show (absence without cancellation), 100% of the treatment price will be charged.
4. If the Client arrives more than 15 minutes late, the treatment may no longer be fully performed and this will be treated as a no-show. The full amount of the booked treatment will then be due.

Article 3 - Best-efforts obligation

Blauw Natuurlijk has a best-efforts obligation towards its clients and not an obligation to achieve a specific result. In consultation with the Client, it will make every effort to achieve the desired result, insofar as this is (medically) feasible and responsible. Blauw Natuurlijk accepts no liability if, despite exercising the utmost care, the desired result cannot be achieved.

Article 4 - Force majeure

1. Blauw Natuurlijk is not obliged to fulfil any obligation towards the Client if it is prevented from doing so due to circumstances beyond its control, and which cannot be attributed to fault, nor for which it is responsible by law, legal act, or generally accepted standards.
2. In the event of force majeure, Blauw Natuurlijk is not liable for any resulting damage.
3. Force majeure includes, among other things: all external causes, foreseen or unforeseen, over which Blauw Natuurlijk has no influence, but which prevent Blauw Natuurlijk from fulfilling its obligations. This includes (but is not limited to) fire, flooding, war, natural disasters and other exceptional weather conditions, strikes, government measures and non-delivery by suppliers.

Article 5 - Responsibilities

1. Employees are responsible for carrying out treatments correctly and professionally.
2. Employees must comply with hygiene and safety regulations.
3. Employees ensure professional and respectful client contact.
4. Blauw Natuurlijk performs treatments to the best of its knowledge and ability, in accordance with applicable professional standards.
5. Blauw Natuurlijk provides a safe and hygienic environment and supplies the required products, materials and tools.
6. Where necessary, Blauw Natuurlijk provides support and training to employees.

Article 6 - Hygiene

1. Blauw Natuurlijk works in accordance with applicable hygiene guidelines.
2. Materials and tools are carefully cleaned or replaced before each treatment.
3. Employees of Blauw Natuurlijk are cosmetically trained and do not provide medical treatments.

Article 7 - Payment

1. All prices as listed on the current price list are for private clients, include VAT, and are shown on the website and in the salon.
2. Payment must be made by debit card (or cash) or in advance online.

Article 8 - Personal data & Privacy

1. Blauw Natuurlijk handles personal data confidentially and in accordance with applicable privacy legislation (GDPR).
2. Data is used exclusively for administrative and communication purposes and is not sold or rented to third parties.

Article 9 - Confidentiality

Blauw Natuurlijk and its employees are obliged to keep confidential all confidential information shared during a treatment or course, unless disclosure is required by law.

Article 10 - Liability

1. Blauw Natuurlijk is not liable for damage arising because the Client provided incorrect or incomplete information.
2. Blauw Natuurlijk is not liable for loss, damage or theft of personal belongings.
3. If the Client causes damage to property of Blauw Natuurlijk, compensation may be claimed.
4. Theft is always reported to the police.

Article 11 - Property

1. Blauw Natuurlijk takes measures that are reasonably possible to prevent damage to or loss of the Client’s belongings.
2. The Client must take appropriate care to prevent damage to or loss of their belongings.
3. Blauw Natuurlijk accepts no liability for damage to or loss of the belongings of Clients. This also applies to belongings left behind.

Article 12 - Complaints

1. Complaints must be reported in writing within 7 days after the treatment or course.
2. Blauw Natuurlijk aims to handle complaints within 48 hours and to reach an appropriate solution.

Article 13 - Proper conduct

1. The Client must behave properly in the salon. In case of repeated improper behaviour, Blauw Natuurlijk may deny the Client access to the salon.
2. Smoking and pets are not allowed in the salon.

Article 14 - Minimum age

1. For treatments with gel polish or BIAB, a minimum age of 16 applies.
2. Younger clients need permission from a parent/guardian and must be accompanied.

Article 15 - Changes and availability of these Terms

These terms & conditions are filed with the Chamber of Commerce under number 98547526 and can be requested at any time from Blauw Natuurlijk in written or electronic form. Blauw Natuurlijk may update these terms at any time. Upon change, all previous versions lapse; the version in force at the time the agreement is concluded applies.

Article 16 - Governing law

All agreements are governed by Dutch law. Disputes will be submitted to the competent court in the district where Blauw Natuurlijk is established.
